Adopté en 2010 lors de la Soixante-Troisième Assemblée mondiale de la Santé (résolution WHA 63.16), le Code de pratique mondial de l’OMS pour le recrutement international des personnels de santé (« le Code ») vise à renforcer la compréhension et la gestion éthique du recrutement international des personnels de santé grâce à l’amélioration des données, des informations et de la coopération internationale.

Aux termes de l’article 7 du Code, chaque État Membre de l’OMS devrait échanger des informations concernant le recrutement international et les migrations des personnels de santé. Le Directeur général de l’OMS doit faire rapport tous les trois ans à l’Assemblée mondiale de la Santé.

Les États Membres de l’OMS ont achevé le quatrième cycle de notification nationale en mai 2022. Le Directeur général de l’OMS a rendu compte des progrès accomplis dans la mise en œuvre à la Soixante-Quinzième Assemblée mondiale de la Santé en mai 2022 (A75/14). Le rapport sur le quatrième cycle a souligné la nécessité d’évaluer les implications de l’émigration de personnels de santé dans le contexte de l’augmentation des vulnérabilités provoquée par la pandémie de COVID-19. À cette fin, le Groupe consultatif d’experts sur l’utilité et l’efficacité du Code (A73/9) a été convoqué à nouveau. Conformément aux recommandations du Groupe consultatif d’experts, le Secrétariat a publié la Liste OMS d’appui et de sauvegarde pour les personnels de santé 2023.

L’Instrument national de notification (INN) est un outil d’autoévaluation à la disposition des pays pour l’échange d’informations et le suivi du Code. Il permet à l’OMS de recueillir et de partager des données probantes et des informations actuelles concernant le recrutement international et les migrations des personnels de santé. Les conclusions du cinquième cycle de notification nationale seront présentées au Conseil exécutif (EB156) en janvier 2025 en préparation de la Soixante-Dix-Huitième Assemblée mondiale de la Santé.

La date limite de présentation des rapports est fixée au 31 août 2024.

Aux termes de l’article 9 du Code, le Directeur général de l’OMS est chargé de soumettre périodiquement un rapport à l’Assemblée mondiale de la Santé pour indiquer dans quelle mesure le Code permet d’atteindre les objectifs qui y sont fixés et faire des suggestions d’amélioration. En 2024, un groupe consultatif d’experts dirigé par les États Membres se réunira pour le troisième examen du Code. Le rapport de l’examen sera présenté à la Soixante-Dix-Huitième Assemblée mondiale de la Santé.

The Federal Government established the “Skilled Labour Strategie” to tackle the challenge of skilled labour shortages. The skilled labour strategy aims to support companies and businesses in attracting and retaining qualified skilled workers with various measures. To this end, the five most important fields of action have been identified: 1. Modern training, 2. Targeted further training, 3. Increasing labour potential and labour force participation, 4. Improving the quality and culture of work, and 5. Modern immigration policy and sustainable labour market integration The federal government's skilled labour strategy, which covers all sectors and regions, is just the starting point and framework. It will continue with a closer look at the individual professions, sectors and other relevant topics. The federal government is already looking forward to the valuable input that the various stakeholders will contribute to this project. The Federal Government is aware of the fact that the shortage of skilled workers in the healthcare sector is a phenomenon that can be observed in many western industrialized countries. The associated competition for international nursing staff will increase in intensity in the coming years. This makes it all the more important that recruitment takes place in a fair, ethical and sustainable manner. In Germany, this is guaranteed by the “Fair Recruitment Care Germany” state seal of approval, which is a unique selling point worldwide and contributes to a significant strengthening of Germany as an immigration country.

The Federal Ministry of Health is planning to introduce a nationwide HWF monitoring and forecasting tool this year that can be used to inform planning in the medium term. On the basis of a skilled worker strategy of the Federal Government, the Federal Ministry of Health is currently working on measures to improve the skilled labour situation for the health and care sector. The aim is to meet the special needs in this area in various fields of action to secure, strengthen and expand personnel.

In the last legislative periods, the support of continuing education and training was significantly extended by the amendments introduced with the Skills Development Opportunities Act (Qualifizierungschancengesetz) and the Work of Tomorrow Act (Arbeit-von-morgen-Gesetz). In 2023 the Act to Strengthen the Promotion of Vocational Training and Skills (Gesetz zur Stärkung der Aus- und Weiterbildungsförderung) introduced further improvements to the general framework and conditions of support. The promotion of continuing vocational education and training provides the Federal Employment Agency with a broad range of funding tools for unemployed persons and employees. The project “Good working conditions in care to reconcile care, family and career” (Gute Arbeitsbedingungen in der Pflege zur Vereinbarkeit von Pflege, Familie und Beruf) supports nursing institutions to improve working conditions for their employees. The legislator has set up the funding programme, which includes offers – such as coaching – to improve the compatibility subsidized. Loi/politique 1
In general, recognition of foreign qualifications can be regarded of one pathway of sustainable integration into the German labour market. For professions in the health sector, the recognition procedures are mandatory. The WHO first identified a critical shortage of healthcare personnel (especially physicians, nurses, and health care workers) in several countries in 2006 and recommended not to actively recruit from these countries. With Section 38 of the Employment Regulation (Beschäftigungsverordnung) and the recruitment ban stipulated therein, the so-called WHO list was made binding in Germany as Annex 1 to Section 38 Beschäftigungsverordnung. It prohibits recruitment of healthcare personnel from these countries, unless the Federal Employment Agency carries out the recruitment. The Federal Employment Agency pursues any intentional or negligent violation of this recruitment prohibition as an administrative offense (Section 404, paragraph 2, no. 9, paragraph 3, Sozialgesetzbuch III). The recently introduced Section 22a of the Employment Regulation allows access to the labour market for assistants in nursing. This means that people with less than three years of vocational training in nursing – or training recognised as less than three years – are able to work in the health and care sector. As a TCN, you must apply for a residence permit before taking up employment as a nursing assistant. This will be issued if the Federal Employment Agency has approved your employment in accordance with Section 22a of the Employment Regulation.

In April 2012 the Federal Recognition Act came into force and readjusted the regulation of recognition of foreign qualifications. The aim was to facilitate recognition and make Germany more attractive to qualified immigrants. It comprises the Professional Qualifications Assessment Act (Gesetz über die Feststellung der Gleichwertigkeit von Berufsqualifikationen ) and amendments to the sectoral laws under legislation relating to specific occupations (esp. health professions). The inherent equivalence assessment enables skilled workers to make their foreign qualifications transparent, to develop prospects for occupational development and thus also to guard against unequal treatment

Since 2021, the “Fair Recruitment Care Germany” state seal of approval has been issued on the basis of this law. The "Fair Recruitment Care Germany" state seal of approval defines requirements for the transparent, fair and sustainable placement of nursing staff from third countries with nursing and healthcare companies in Germany. Companies, mostly private recruitment agencies but also healthcare and nursing facilities that recruit internationally without the involvement of an agency, voluntarily and verifiably commit to ethical recruitment and placement practices. The requirements include, for example, the employer pays principle, transparency and sustainability.

When recruiting health personnel the Federal Employment Agency orientates itself on the IOM IRIS Ethical Recruitment Standards. For the recruitment of health personnel, the BA has concluded placement agreements with different countries. These placement agreements outline the process and the obligations of the future employee and the employer. In addition, there is a publicly funded counselling service for refugees and migrants from third countries (outside the EU) on social and labour law issues, called “Fair Integration”. The counselling service is available in all federal states and is provided by various organisations. Counselling is offered free of charge, anonymously and in various languages of origin. Counselling topics include labour and social law issues that are directly related to the employment relationship, such as working hours, dismissal, temporary work and many more. The "Fair Recruitment Care Germany" state seal of approval defines requirements for the transparent, fair and sustainable placement of nursing staff from third countries with nursing and healthcare companies in Germany. Companies, mostly private recruitment agencies but also healthcare and nursing facilities that recruit internationally without the involvement of an agency, voluntarily and verifiably commit to ethical recruitment and placement practices. The requirements include, for example, the employer pays principle, transparency and sustainability, including a clear information policy, that allows for a informed decision making.

During the visa process, the Federal Employment Agency examines the equivalence of the working conditions. International health personnel from non-EU countries is only granted admission to the German labour market if the working conditions of the employment are comparable with those of domestic employees. This includes that the remuneration must be in line with local market and industry standards. Health personnel also undergo a recognition procedure in Germany aimed at establishing the equivalence of foreign qualifications and thus an adequate remuneration.

Migrant health personnel has the same access to support measures from the Federal Employment Agency as local care workers, if the respective requirements are met. The Federal Ministry of Labour and Social Affairs had launched the funding line „Fair integration“. Fair Integration is a counselling service for all branches in Germany for refugees and migrants from third countries (outside the EU) on social and labour law issues. The counselling service is available in all federal states and is provided by various organisations. Counselling is offered free of charge, anonymously and in various languages of origin. Counselling topics include labour and social law issues that are directly related to the employment relationship, such as working hours, dismissal, temporary work. The offer since 2019 was carried out by temporary counselling projects (funded by European Social fund and national contribution). After 2026 „fair integration“ will become a permanent offer.

GSP – Global Skills Partnership The GSP project supports the qualification of nursing staff from selected third countries for the German nursing labor market. To this end, a directly recognizable nursing qualification will be established in accordance with German requirements, including the necessary technical language skills. Work shadowing and train-the-trainer elements help to promote a sustainable knowledge transfer to the respective country of origin and circular migration.
