Hide [S01] Monitoring progress on the implementation of Code – Second round reporting (2015-2016)

On May 21, 2010 the WHO Global Code of Practice on the International Recruitment of Health Personnel (the “Code”) was adopted by the 193 Member States of the World Health Organization. The Code encourages information exchange on issues related to health personnel and health systems in the context of migration, and suggests regular reporting every three years on measures taken to implement the Code. The reporting process is an integral component of the effective implementation of the voluntary principles and practices recommended by the Code.


A self-assessment tool for countries second-round reporting


To monitor the progress made in implementing the Code, and in accordance with the request of the World Health Assembly (Resolution WHA63.16), a national self-assessment tool was created for Member States. 

You have been nominated as Designated National Authority (DNA) to respond to the updated national reporting instrument (NRI) via this web-based data interface.

Pursuant to article 43.2 – Act of Law on Higher Education of 27 July 2005 (Journal of Law of 2012, item 572, as amended) there are groups of foreigners who may enroll on, and follow, education or training courses and participate in research and development work pursuant to the rules applicable to Polish nationals non-nationals: • non-nationals who were granted settlement permit; • non-nationals having refugee status granted in the Republic of Poland; • foreigners benefiting from temporary protection on the territory of the Republic of Poland; • migrant workers being citizens of European Union Member States, Swiss Confederation or European Free Trade Association (EFTA) Member States – parties to the Agreement on the European Economic Area, as well as members of their families provided that they live on the territory of the Republic of Poland; • non-nationals who were granted European Union long-term resident permit on the territory of the Republic of Poland; • foreigners who were granted temporary residence permit on the territory of the Republic of Poland due to the circumstances mentioned in Article 53 (1) (7), 13 and 14 of the Foreigners Act of 13 June 2003 (Journal of Laws No 128, item 1175, as amended); • foreigners who were offered secondary protection on the territory of the Republic of Poland; • citizens of European Union Member States, European Free Trade Association (EFTA) Member States – parties to the Agreement on the European Economic Area, or Swiss Confederation, as well as members of their families having permanent residence permits. Other foreigners may enroll on, and follow, education or training courses and participate in research and development work on the basis of Article 43.3 of the said Act on the basis of: 1) International agreements, pursuant to the rules set out in these agreements; 2) Agreements concluded by higher education institutions with foreign entities, pursuant to the rules set out in these agreements; 3) Decision by the minister competent for higher education or by the responsible minister specified in Article 33 (2) (Minister of Health in the case of medical higher education institutions); 4) Decision by the rector of higher education institution. Pursuant to Article 43.3.3 and Article 43.4 of the said Act, foreigners may enroll on, and follow, education or training courses and participate in research and development work referred to in section as: - As holders of scholarship awarded by the Polish Party; - on a fee-paying basis; - without tuition fee and scholarship benefits - as holders of scholarships awarded by sending party, without paying tuition fees; - as holders of scholarships awarded by higher education institutions Pursuant to Article 43.5 citizens of European Union Member States, Swiss Confederation or European Free Trade Association (EFTA) Member States – parties to the Agreement on the European Economic Area, as well as members of their families, who possess financial resources needed to cover costs of maintenance during the period of study may enroll on, and follow, degree programs, doctoral programs and other forms of education or training, as well as participate in research and development work pursuant to the rules applicable to Polish nationals, with no entitlement however to a maintenance grant, special grant for disabled persons, or pursuant to the rules laid down in section 3 and 4. Moreover, pursuant to Article 43.5a holders of a valid Card of the Pole may enroll on, and follow, degree programs, doctoral programs and other forms of education or training, as well as participate in research and development work pursuant to the rules applicable to Polish nationals or pursuant to the rules laid down in section 3 and 4. Migrant health workforce have the same legal rights and responsibilities as the domestically trained health professionals. The right to practice and the conditions are recorded in the local acts for the following medical professionals: doctors, dentists, pharmacists and laboratory diagnosticians, nurses and midwives
