Constitutional highlights

Health related rights

The right to health is recognized in the Constitution along with other rights. Specifically, article 10 of the Constitution provides that education, training, work, housing, leisure, health, social protection, and access to food and water are recognized rights.

Mandate for health

The constitution lists the areas that should be addressed by law under article 115. While there are no specific reference to health, several areas falling under the competence of the law, relate to health and / or influence health. This includes among others: civic rights and fundamental guarantees, taxation, general status of civil servants, status of professional orders, labour law, social security law and trade union law, education and research, environmental protection, the principles governing the creation, organisation and control of public services and bodies, the free administration of local authorities, and the administrative organisation of the territory (article 115). Under article 116, areas other than those falling within the scope of the law are governed by regulations.

Legislative and regulatory priorities

National health policy

The law n°02-049 providing orientation for health, as modified by Law n°2018-049, sets the general orientations for the national health policy. This law provides that the national health policy is based on the fundamental principles of equity, justice, solidarity, participation by the population and civil society and takes into account the international commitment to which the country has subscribed (article 2). Priorities for health action are disease prevention, health promotion and the well-being of the family in rural and peri- urban areas, as well as improving access to healthcare for the most vulnerable populations (article 5).

National health plan

No current health plan was located; the previous health and social development plan, named "plan décennal de développement sanitaire et social 2014-2023", covered the period 2014-2023.
