History and summary of decisions by the Conference of Parties (COP) to the WHO Framework Convention on Tobacco Control (WHO FCTC) regarding Article 13 and TAPS

The Ninth Session of the Conference of the Parties (COP9)

  1. discussion on the draft text for specific guidelines to address cross-border TAPS and the depiction of tobacco in the entertainment media deferred to the Tenth Session of the Conference of the Parties (COP10).

The Eighth Session of the Conference of the Parties (COP8)

established a Working Group to develop specific guidelines to address cross-border TAPS and the depiction of tobacco in the entertainment media:

  1. taking into account the report of the Expert Group on Tobacco Advertising, Promotion and Sponsorship: Depiction of Tobacco in the Entertainment Media and other previous work, notably documents FCTC/COP/4/10 and FCTC/COP/3/9; and
  2. submitting for consideration of the Ninth Session of the Conference of the Parties (COP9) a draft text for specific guidelines to address cross-border TAPS and the depiction of tobacco in the entertainment media.

The Seventh Session of the Conference of the Parties (COP7)

COP7 requested the establishment of an expert group on TAPS: depiction in entertainment media:

  1. to review the evidence base relating to how the depiction of tobacco in the entertainment media can promote tobacco use;
  2. to collect examples of action addressing the depiction of tobacco in the entertainment media at national and regional level;
  3. to provide recommendations on operationalizing the implementation of Article 13 and its Guidelines on cross-border advertising and TAPS in entertainment media; and
  4. to prepare a report for COP8.

The Fourth Session of the Conference of the Parties (COP4)

COP4 established an expert group on cross-border TAPS, with the following mandate, subject to prioritization of work by the COP:

  1. keep the COP updated on relevant technology developments regarding cross-border TAPS and best practices for responding to the same;
  2. monitor and review the “Guidelines for Implementation of Article 13” and the arrangements established to facilitate international cooperation; and
  3. noting that in the Workplan and Budget for 2012–2013, the expert group was included as an unbudgeted recommended activity, subject to funding as it was not considered a priority.

The Third Session of the Conference of the Parties (COP3)

Article 13 Guidelines adopted.

COP3 adopted the guidelines for implementation of Article 13.4:

  1. noting the recommendations of the working group on possible key elements of a protocol on cross-border TAPS;
  2. noting also the recommendations of the working group on measures that would contribute to the elimination of cross-border TAPS;
  3. further considering the recommendations at the Second Session of the Conference of the Parties (COP4); and
  4. requesting the Secretariat to assess implications of the recommendations and propose options for further work at COP4.

The Second Session of the Conference of the Parties (COP2)

COP2 established a Guidelines working group.

The expert group reported to COP2, including a template for a protocol, but the report raised the concern that the negotiation of a protocol might be premature in light of too many obligations, preferring to start by:

  1. developing guidelines;
  2. preparing comprehensive draft guidelines on the implementation of both the domestic and cross-border elements;
  3. presenting recommendations on key elements of a protocol on cross-border TAPS, which would be complementary to the guidelines; and
  4. developing recommendations on any other measures that would contribute to the elimination of cross-border TAPS.

The First Session of the Conference of the Parties (COP1) to the WHO FCTC establishes Protocol expert group

COP1 established an expert group mandated with preparing a template for a protocol on cross-border TAPS on the basis of Article 13.8 of the WHO FCTC.
