Health Legislation

The Local Governance Act (Act 936) of 2016 provides for local governance in accordance with the Constitution; establishes a Local Government Service; provides for the establishment and administration of the District Assemblies Common Fund; provides for a National Development Planning System; defines and regulates planning procedures of District Assemblies; co-ordinates, facilitates, monitors and supervises internal audit activities within District Assemblies and related matters.

This decree, taken in application of the provisions of Ordinance No. 01/95 of January 14, 1995, on the orientation of health policy in the Gabonese Republic and Ordinance No. 10/2011 of August 11, 2011, on the organization of the pharmaceutical sector in the Gabonese Republic, sets the conditions for opening and operating a private health structure in the Gabonese Republic. This decree, taken in application of the provisions of Ordinance No. 01/95 of January 14, 1995, on the orientation of health policy in the Gabonese Republic, of Law No. 4/63 of January 11, 1963, relating to the practice of private medicine in the Gabonese Republic, of Decree No. 213/PR-MSPP-CAB of July 8, 1966 on the regulation of the practice of the professions of doctor, dental surgeon and midwife in the Gabonese Republic, sets the conditions for issuing authorizations relating to the practice of medical and paramedical professions in the Gabonese Republic. This order, taken in application of the provisions of Decree No. 213/PR-MSPP-CAB of July 8, 1966 on the regulation of the practice of the professions of doctor, dental surgeon and midwife in the Gabonese Republic and Orders No. 0106/MSPS and 0107/MSPS of March 16, 2015, determines the amounts and terms of payment of fees relating to the issue of authorization to practice medicine, to open and operate a private health structure in the Gabonese Republic. This decree, taken in application of the provisions of Law No. 020/2005 of January 3, 2006, establishes the creation and attributions of the Monitoring/Evaluation Committee for the issuance and implementation of authorizations for the exercise, opening and operation of private health structures in the Gabonese Republic. The Health Professions Regulatory Bodies Act of 2013 establishes the Allied Health Professions Council, the Medical and Dental Council, the Nursing and Midwifery Council, the Pharmacy Council, the Psychology Council and provides for related purposes.

This decree, taken in application of the provisions of Law No. 020/2005 of January 3, 2006 and of Article 95 of Ordinance No. 1/95 of January 14, 1995, sets out the attributions and organization of regional hospital centers.

The National Health Insurance Act was adopted to establish a National Health Insurance Authority to implement a National Health Insurance Scheme, establish a National Health Insurance Fund to pay for the cost of health care services to members of the Scheme, establish private health insurance schemes, and to provide for related matters.

The National Public Health Act revises and consolidates the law relating to public health to prevent disease, promote, safeguard, maintain and protect the health of humans and animals and to provide for related matters.

The Mental Health Act of 2012 provides for mental health care and for related matters. Among other things, it establishes a Mental Health Authority (sections 1 to 23), enshrines a set of rights for persons with mental disorder (sections 54 to 63), and establishes a mental health fund (sections 80 to 87).

The Data Protection Act of 2012 establishes a Data Protection Commission, to protect the privacy of the individual and personal data by regulating the processing of personal information, to provide the process to obtain, hold, use or disclose personal information and for related matters.

This decree, taken in application of the provisions of Law No 20/2005 of January 3, 2006, provides for the reorganization of the National Pharmaceutical Office, abbreviated to OPN.

The document establishes the principles, norms and standards for the organization of the health care sector in Gabon.

This order, taken in application of the provisions of order No 001/95 of January 14, 1995, concerning the orientation of health policy in the Gabonese Republic, concerns the organization of the pharmaceutical sector.

The Health Institutions and Facilities Act of 2011 provides for a Health Facilities Regulatory Agency to license facilities for the provision of public and private health care services, establishes the Mortuaries and Funeral Facilities Agency to control and regulate facilities connected with the storage and disposal of human remains, establishes an Ambulance Council to regulate the operation of ambulance services in the country in accordance with policy standards and to provide for related matters.

This decree, taken in application of the provisions of article 62 of order No. 0022/PR/2007 of August 21, 2007, defines the basket of care of the Compulsory Health Insurance and Social Security Scheme.

This decree, taken in application of the provisions of Articles 28 et seq. of Ordinance No. 0022/PR/2007, 6 et seq. of Ordinance No. 0023/PR/2007 and 3 et seq. of Law No. 11/82 of 24 January 1983, establishes the statutes of the National Health Insurance and Social Guarantee Fund, abbreviated to CNAMGS, hereinafter referred to as "the Fund".

This decree, taken in application of the provisions of articles 51 of the Constitution and 107 of Ordinance No. 0022/PR/2007 of August 21, 2007, establishes the technical operating procedures of the Compulsory Health Insurance and Social Security Scheme.

The National Identity Register Act of 2008 provides for the capture of personal information by individuals by the National Identity Authority for the issue of national identity cards; for the protection of the personal information; for conditions of access, use, retention and disclosure of information and for related matters.

This decree, taken in application of the provisions of article 109 of Ordinance No. 01/95/PR/MSP of January 14, 1995, sets out the procedures for the care of patients in public health facilities.
