Health Legislation

The purpose of these Regulations is to establish the organizational and operating rules of the National Medicines Council, a body provided for in the Organic Chart of the Ministry of Health, approved by Decree-Law no. 56/2021 of 21 September, which establishes the structure and operating rules of the Ministry of Health.

The objective of this law is to determine the rules for the organization and the functioning of the National Order of Doctors.

This Ordinance regulates the establishment, organization and functioning of the National Council for Universal Health Coverage in the Democratic Republic of the Congo.

The Insurance Act of 2021 establishes the National Insurance Commission, and provides for the regulation and supervision of the insurance market and related matters.

This decree establishes the National Institute for Medical Assistance (Institut National d'Assistance Médicale) whose mission is to implement the policies, strategies an reforms for finanicng and managing free healthcare services for vulnerable populations. It is under the ministry of health (technical supervision) and the Ministry of Finances (financial suppervision). The decree further addresses the mandate, structure and ressources of the Institute.

The Constitution was adopted by referendum in November 2020 and has been promulgated by Presidential decree n°20-442. It includes 225 articles addressing a wide array of issues including Fundamental Principles for the Society, Fundamental Rights, Freedoms and Duties, and Organization and Separation of Powers (non-exhaustive list).

The Law establishes the Legal Framework for the Formation and Execution of Public Contracts.

The Decree approves the organic statute of the Ministry of Health whose mission is to define and implement the National Health Policy, promote the execution of the Executive's program on health and exercise the corresponding normative and monitoring functions, aiming for universal health coverage in the country.

The law establishes and organizes the government's ministerial departments.

The legislation regulates the production, import, export, conservation, distribution, quality analysis and sale of medicines for human use, including traditional medicines, as well as all other health products, pharmaceutical practice and opticianry.

The Decree defines the normative framework for the organization and operation of the Ministry of Public Health and the fight against AIDS.

The Law makes the first amendment to the Law no. 41/VI/2004, of April 5, which establishes the foundations of the National Health Service.

This decree establishes and organizes the General Directorate for the Evaluation of Public Policies.

This Order establishes the creation, attributions and organization of the National Order of Midwives of Gabon.

The Constitution of Guinea was reviewed in 2020. The Constitution contains 156 articles addressing a large number of issues as the protection of fundamental rights and freedoms, the fundamental principles of the state and institutional arrangements.

This Decree provides for the definition of attributions of the Minister of Health and the organization of the Central Administration of his Department. The Decree also contains provisions regarding the organization of other departments of the Ministry of Health. This Decree establishes the special status of civil servants of the of the health corps classified in the following areas of specialization: medical-sanitary; medical sanitary engineering and public hygiene; biology. The decree creates a National Technical Committee responsible for the administration of the District Health Information System in Niger. Its mission is to ensure the administration and updating of the platform; to identify and deal with users' technical grievances and concerns, and to ensure the system's security, maintenance and capacity building.
