Constitutional highlights
Article 55 of the Constitution of Burundi proclaims that every person has the right to access health care. Furthermore, under article 19, the rights and duties proclaimed and guaranteed by international human rights instruments that have been ratified by the country are an integral part of the Constitution.
Article 164 lists the areas that are governed by law; are included among other things the following: fundamental guarantees and obligations of the citizen (item 1), political, administrative, judicial and diplomatic organization including territorial organization, organization of national orders, status of the civil service, state of exception (item 3), financial issues including the state budget and taxes (item 5), education system (item 7), sustainable development system (item 8), labour legislation, social security (item 9).
Matters other than those covered by the law have regulatory status (art. 165).
Legislative and regulatory priorities
The main goal of the "Politique Nationale de Santé 2016-2025 du Burundi" is to achieve the highest possible level of health for the Burundian population.
To achieve this goal, three general objectives are defined: reduce the extent and severity of priority diseases ; improve the performance of health systems and; strengthen intersectoral collaboration (pages 10-11, 41).
The policy identifies action areas supporting each of these objectives, including: the reduction of the incidence and severity of priority health problems, improvement of the health system's performance, and strengthening intersectoral collaboration for better health outcomes. Specific strategies include controlling and eliminating communicable diseases, enhancing maternal and child health, combating malnutrition, and preparing for and responding to emergencies and disasters (pages 44-61).
The situational analysis, included in chapter 2, refers to implementation challenges around private sector regulation (section 2.2.2.7).
Priority action areas, highlighted in chapter 6, include various references to legal and regulatory actions e.g., strengthening legal and regulatory framework for pharmaceutical products (section 6.2.1.2) or adopting legislation to improve access to vulnerable populations and repeal legislation creating access barriers (section 6.3.1) (non exhaustive-list).
While references to a sectoral plan for health covering the period 2021-2027 were found on various sources, the actual document was not located.
