This decree defines the scope of the prohibition on smoking in public places or places open to the public, and specifies the powers of health police officers in enforcing the law on tobacco control. It also sets out the rules governing the liability of manufacturers and distributors of tobacco products in the event of damage caused by the consumption of these products.

This Law amends Articles 1, 2 and 12 of Law No 2000-01 of January 10, 2000 establishing a public health establishment with special status called "Hôpital Principal de Dakar"

The purpose of this Act is to: a) protect the health of the population against the many debilitating and fatal diseases caused by tobacco; b) limit the population's access to tobacco and protect it from inducements to use tobacco and the smoking which may result; c) make the population aware of the dangers of tobacco use and exposure to tobacco smoke.

Constitution

The Constitution of Senegal was adopted 2001 and promulgated by law No 2001-03 of 22 January 2001. The Constitution consists of 103 articles that are grouped into 12 titles. The Constitution establishes key principles and values of the state, provides for the separation of powers, establishes the rights and freedoms of the people, sets up the key state organs and their mandates, etc.

This decree establishes an autonomous fund to receive revenues from the recovery of primary health care costs in each Integrated Health Center. This fund will primarily support the purchase of essential generic drugs and consumables, the purchase of management tools for cost recovery and the payment of managers' salaries.

The Labour Code of Senegal contains a compilation of rules governing labour relations and workers rights in Senegal.

The decree creates a technical-administrative division known as a health district for towns, departments, arrondissements and communes. The Health District is the local level for the design, planning, implementation, monitoring and evaluation of health policy.

The order M°154/MSP/CAB of 29 December 1994 provides the structure and mandate for the Departmental Directorate for Health ("Direction Departementale de la Santé"); this directorate represents the Ministry of Public Health at the level of the department or the urban community and participates in the elaboration, implementation and evaluation of the National Health policy ( providing the competence of the Department Direction for Health).
