Decreto-Lei No 3/2019

This decree creates the Independent Health Regulatory Authority, defining its attributions, organization and functioning. The status of the organization are in annex to this Decree.

This law, published in the Official journal on 7 November 2019, is to put in place a system to ensure the protection of the fundamental rights and freedoms of individuals, in particular their privacy, with regard to the processing of personal data; and to ensure that information and communication technologies remain at the service of the citizen and do not infringe individual freedoms.

The objective of the law is to provide the general orientation, the principles and fundamental objectives of the State for Health. It considers the international commitments to which the country adhered to.

Loi No 2019-676 relative à la lutte anti-tabac

This law relates to the fight against tobacco; it applies to tobacco growing, regulation of the manufacture, packaging, labelling, marketing and importing of tobacco and tobacco products, as well as advertising.

This Law aims to determine the framework for hospital reform and applies to hospitals ensuring a public service mission.

This Proclamation is to provide for Food and Medicine Administration. It provides rules to regulate several areas including food, medicine, medical devices, cosmetics, and tobacco products.

Right to Information Act, 2019 Act 989

The Right to Information Act of 2019 provides for the implementation of the constitutional right to information held by a public institution, subject to the exemptions that are necessary and consistent with the protection of the public interest in a democratic society, to foster a culture of transparency and accountability in public affairs and to provide for related matters.

The Data Protection Act

This Act gives effect to Article 31(c) and (d) of the Constitution; establishes the Office of the Data Protection Commissioner; makes provision for the regulation of the processing of personal data; provides for the rights of data subjects and obligations of data controllers and processors; and for connected purposes.

Pharmacy and Medicines Regulatory Authority Act

This Act establishes the Pharmacy and Medicines Regulatory Authority; provides for the functions and powers of the Authority; and provides for matters connected therewith and incidental thereto.

The purpose of the law is to determine the legal regime of civil status in Niger. It institutes a civil status system, which is the set of qualities inherent to a person that the law takes into consideration in order to attach legal effects to that person. The law governs declarations of civil status facts.

This Law amends and supplements Articles 185 and 195 of Law No 2013-10 relating to the General Code of Local Authorities

The purpose of the law is to regulate the collection, processing, transmission, storage, use, and protection of personal data.

The Data Protection and Privacy Act

This Act protects the privacy of the individual and of personal data by regulating the collection and processing of personal information; provides for the rights of the persons whose data is collected and the obligations of data collectors, data processors and data controllers; regulates the use or disclosure of personal information; and provides for related matters.

This Act lays down the fundamental provisions and principles and aims to give concrete form to the rights and duties of the population in matters of health. Its purpose is to ensure the prevention, protection, maintenance, restoration and promotion of people's health. It was published in the Official Journal on 29 July 2018.

Consumer Protection Act

The Act contains provisions to provide protection of the interests of consumers by means of investigation, prohibition and control of unfair business practices; and to provide for matters incidental thereto.

Data Protection Act

This Act regulates the protection of personal data and ensures that the privacy of individuals in relation to their personal data is maintained. It also establishes the Information and Data Protection Commission and provides for all matters incidental thereto.

The aim of the law is to promote and protect the rights of persons with disabilities for their effective integration, so that their dignity is preserved and they can benefit from conditions that enable them, where appropriate, to be useful to themselves, their families, their communities and society as a whole by breaking down barriers of all kinds.

The decree provides the National List of Essential Medicines.

This Law establishes the fundamental principles relating to the organization of public health in the Democratic Republic of the Congo.

The law regulates the manufacture and registration of medicines, the approval of medical devices, and sets out rules for pharmacies and the practice of the profession of pharmacist.
