ان حقوق الطفل هي جزء ال يتجزأ من حقوق االنسان. غير أن االطفال يحتاجون إلى حماية ورعاية خاصة بهم، لذلك جاءت االتفاقية الدولية لحقوق الطفل، التي أقرتها الجمعية العامة الامم المتحدة في مؤمتر القمة العالمية في 20 تشرين الثاين عام 1989 ودخلت حيز التنفيذ في الثاني من ايلول عام 1990 من أجل بقاء الطفل وحاميته لتشكل مع وثيقة عامل جدير باالطفال، التي تشدد على بداية مميزة للطفولة )الطفولة المبكرة( والتعليم ذي النوعية الجيدة، ومشاركة االطفال في التنمية البشرية، وغيرها من المواثيق الدولية ذات الصلة، االإطار القانوين الملزم للدول الموقعة والمصدقة عليها، ولتجعل تطبيقها وتعزيز الحقوق التي تنص عليها من مسؤولية الدولة والمجتمع معا.
