Description

A lei estabelece os princípios gerais seguintes:

1 - A protecção da saúde constitui um direito dos indivíduos e da comunidade que se efectiva pela responsabilidade conjunta dos cidadãos, da sociedade e do Estado, em liberdade de procura e de prestação de cuidados, nos termos da Constituição e da lei.

2 - O Estado promove e garante o acesso de todos os cidadãos aos cuidados de saúde nos limites dos recursos humanos, técnicos e financeiros disponíveis.

3 - A promoção e a defesa da saúde pública são efectuadas através da actividade do Estado e de outros entes públicos, podendo as organizações da sociedade civil ser associadas àquela actividade.

4 - Os cuidados de saúde são prestados por serviços e estabelecimentos do Estado ou, sob fiscalização deste, por outros entes públicos ou por entidades privadas, sem ou com fins lucrativos.

The law establishes the following general principles:

1 - The protection of health is a right of individuals and communities to take effect by the joint responsibility of citizens, society and the state, at liberty to demand and care, under the Constitution and the law.

2 - The State shall promote and guarantee access of all citizens to health care within the limits of the available human, technical and financial resources.

3 - Promoting and protecting public health are made through the activities of the state, other public entities and potentially civil society.

4 - Health care and services are provided by state institutions or under their supervision by other public bodies or private entities, for-profit or non-profit.
