Esta lei institui a Política Nacional de Proteção dos Direitos da Pessoa com Transtorno do Espectro Autista; e altera o § 3o do art. 98 da Lei no 8.112, de 11 de dezembro de 1990.

São diretrizes da Política Nacional:

1) A intersetorialidade no desenvolvimento das ações e das políticas e no atendimento à pessoa com transtorno do espectro autista;
2) A participação da comunidade na formulação de políticas públicas voltadas para as pessoas com transtorno do espectro autista e o controle social da sua implantação, acompanhamento e avaliação;
3) A atenção integral às necessidades de saúde da pessoa com transtorno do espectro autista, objetivando o diagnóstico precoce, o atendimento multiprofissional e o acesso a medicamentos e nutrientes;
4) O estímulo à inserção da pessoa com transtorno do espectro autista no mercado de trabalho, observadas as peculiaridades da deficiência e as disposições da Lei no 8.069, de 13 de julho de 1990 (Estatuto da Criança e do Adolescente);
5) A responsabilidade do poder público quanto à informação pública relativa ao transtorno e suas implicações;
6) O incentivo à formação e à capacitação de profissionais especializados no atendimento à pessoa com transtorno do espectro autista, bem como a pais e responsáveis;
7) O estímulo à pesquisa científica, com prioridade para estudos epidemiológicos tendentes a dimensionar a magnitude e as características do problema relativo ao transtorno do espectro autista no País.


This law establishes the National Policy for Protection of the Rights of Persons with Autism Spectrum Disorder; and amends section 3 of article no. 98 of Law 8.112, from December 11, 1990.

The guidelines of the National Policy emphasize:

1) Intersectoriality in the development of actions, policies, and care of people with autism spectrum disorder;
2) Community participation in the formulation of public policies for people with autistic spectrum disorder and the social control of its implementation, monitoring and evaluation;
3) Full attention to the health needs of people with autism spectrum disorder, targeting early diagnosis, multidisciplinary care and access to medicines and nutrients;
4) The inclusion of people with autism spectrum disorder in the labor market, considering the peculiarities of disability and the provisions of Law 8069 of July 13, 1990 (Statute of Children and Adolescents);
5) The responsibility of the government to provide information on the disorder and its implications;
6) The formation and training of professionals specializing in the care of people with autism spectrum disorder, as well as parents and guardians;
7) Scientific research, with priority given to epidemiological studies intended to scale the magnitude and characteristics of autistic spectrum disorder in the country.
