Description

Die Verfassung des Freistaates Bayern regelt die Selbstständigkeit des Freistaates als Land der Bundesrepublik Deutschland. Sie wurde am 26. Oktober 1946 von der Landesversammlung beschlossen. Nach einer Feststellung des Ministerrats vom 4. Dezember trat sie mit ihrer Veröffentlichung im Bayer. Gesetz- und Verordnungsblatt am 8. Dezember 1946 in Kraft.
Die Bayerische Verfassung ist in vier Hauptteile gegliedert und enthält insgesamt 188 Artikel. In den ersten drei Artikeln ist festgelegt, dass Bayern ein Freistaat ist, dass die Staatsgewalt vom Volk ausgeht und dass Bayern ein Rechts-, Kultur- und Sozialstaat ist.
Die Verfassung kann nur im Wege der Gesetzgebung geändert werden (Artikel 75). Beschlüsse des Landtags auf Änderung der Verfassung müssen dem Volk zur Entscheidung vorgelegt werden.
