JUDICIAL ASSISTANCE i.e JUDICIAL GUARDIANSHIP
Sections 1666-1689 specifically deal with legal capacity

Section 1666: a person of full age shall be placed under judicial assistance: 1. where by reason of spiritual or intellectual disturbance…he cannot whether in whole or in part take care himself of his affairs

Section 1667: the placing under judicial assistance shall be decided by the Court

Section 1668: …the heads of mental health units are under obligation to notify the Court of any case that may entail the placing of a person under judicial assistance as soon as they are informed accordingly

Section 1676: …the Court may either: 1. declare such person unable to carry out any or certain legal transactions because it considers that he cannot take personally action in respect thereof or: 2. determine that for the validity of all or certain of the legal transactions shall be required the consent of the judicial assistant or: 3. decide a combination of the two previous regulations.

Section 1685: Where the reasons on account of which the judicial assistance was decided have ceased to exist such assistance shall be lifted by a Court decision

Section 1687: Where the condition of a person requires his compulsory treatment in a mental health unit his introduction in the unit shall take place after a previous permission of the Court and in accordance with the provisions of special laws
