Australia WPR As outlined in C3212, Australian states and territories govern the sale of tobacco products to consumers, varying across different jurisdictions. • For example, the Victorian Minister for Health has the power to ban a product or class of product if the product: • Resembles a tobacco product • Is a tobacco product and possesses a distinctive fruity, sweet or confectionary-like character; or • Is of nature or is advertised in a way that may encourage children or young people to smoke. Victoria operates a successful state-wide program to test retailer compliance with cigarette sales to minors’ laws. There are substantial penalties for those who breach the law. Other the other hand, in NSW, the Public Health (Tobacco) Act 2008 and the Public Health (Tobacco) Regulation 2022 regulate the advertising and display of tobacco products, e-cigarette and e-cigarette accessories, and non-tobacco smoking products, and ban the supply of these products to children. Canada AMR Answer not provided In 2018, the Tobacco Act was amended. It is now known as the Tobacco and Vaping Products Act. As part of the amendments, a prohibition on sending or delivering a tobacco product to a young person was added. In response to 3.3.2.1, in Canada, at a national level, the minimum legal age of 18 is set out in the Tobacco and Vaping Products Act. Provinces and territories can choose to enforce an older age. As of December 2019, the minimum age set in the provinces of Ontario, British Columbia., New Brunswick, Nova Scotia, Prince Edward Island, and Newfoundland and Labrador was 19. In response to 3.3.2.2, while national laws do not require that all sellers of tobacco products place a clear and prominent indicator inside their point of sale about the prohibition of tobacco sales to minors, some sub-national laws do require them. In response to 3.3.2.5. while Canada does not have a federal prohibition, one province (Nova Scotia) and two territories (Yukon and Nunavut) have legislation prohibiting candy or sweets that look like tobacco products.
