Ecuador AMR La “Ley Orgánica para la Regulación y Control del Tabaco”, publicada en el Registro Oficial Nro. 497 de fecha 22 de julio de 2011, en el Título V, referente al “régimen administrativo y sancionador”, se recogen las acciones referentes a la “responsabilidad”, misma que insta a que las autoridades responsables de la aplicación de la Ley, que no cumplieren con su obligación, estarán sujetas a las acciones administrativas, civiles y/o penales a que hubiere lugar. En lo que respecta a las acciones vinculadas con la imposición de sanciones frente al incumplimiento de la “Ley Orgánica para la Regulación y Control del Tabaco”, es importante mencionar lo siguiente: Mediante Decreto Ejecutivo No. 1290, publicado en el Suplemento del Registro Oficial No. 788 de 13 de septiembre de 2012, se creó la Agencia Nacional de Regulación, Control y Vigilancia Sanitaria - ARCSA, “Doctor Leopoldo Izquieta Pérez”, como persona jurídica de derecho público, con independencia administrativa, económica y financiera, adscrita al Ministerio de Salud Pública; El artículo 9 del Decreto Ejecutivo No. 1290, señala: “La Agencia Nacional de Regulación, Control y Vigilancia Sanitaria - ARCSA, Doctor Leopoldo Izquieta Pérez, será el organismo técnico encargado de la regulación, control técnico y vigilancia sanitaria de los siguientes productos: (…) productos del tabaco (…)así como de los establecimientos sujetos a vigilancia y control sanitario establecidos en la Ley Orgánica de Salud y demás normativa aplicable, exceptuando aquellos de servicios de salud públicos y privados.”; El artículo 10 del precitado Decreto manifiesta: “(…) Son atribuciones y responsabilidades de la Agencia Nacional de Regulación, Control y Vigilancia Sanitaria las siguientes: “(…) 13.
